TERMS AND CONDITIONS

These Terms and Conditions govern your use of The Photography Co website and any photography, videography, live streaming, studio, post-production or related services supplied by The Photography Co.

Please read these Terms carefully before using our website, accepting a quotation, paying a deposit or confirming a booking.

By using this website, submitting an enquiry, accepting a quotation, paying a deposit, making a booking or instructing us to begin work, you confirm that you have read, understood and agreed to these Terms and Conditions.

1. About The Photography Co

​

In these Terms, “The Photography Co”, “we”, “us” and “our” refer to the licensed business operating under the name The Photography Co in Dubai, United Arab Emirates

.

The terms “client”, “you” and “your” refer to the person, company, organisation or authorised representative requesting or purchasing our services.

​

If the name shown on our trade licence differs from the trading name The Photography Co, the licensed legal entity identified on the relevant quotation or invoice will be the contracting party.

2. Scope of These Terms

​

These Terms apply to:

  • Use of our website and its content

  • Photography and portrait sessions

  • Corporate headshots and team photography

  • Event photography and videography

  • Wedding and private-event coverage

  • Family, maternity, newborn and baby photography

  • Product, food, fashion and commercial photography

  • Interior, architecture and hospitality photography

  • Video production and post-production

  • Live streaming and multi-camera production

  • Photo booths and 360 booths

  • Studio hire and location production

  • Editing, retouching and other post-production services

  • Any other services described in our quotation, invoice or written agreement
     

A quotation, production agreement, statement of work, invoice or written project confirmation may contain additional project-specific terms.

Where there is a conflict, the following order of priority applies:

  1. A signed production agreement or contract

  2. The accepted quotation or statement of work

  3. The invoice and written booking confirmation

  4. These Terms and Conditions
     

3. Website Information

​

We make reasonable efforts to keep the information on our website accurate and current. However, website content is provided for general information and may be changed without notice.

​

Images, videos, package details, prices, turnaround times and service descriptions shown on the website are examples and may not apply to every assignment.

​

The final scope, price, schedule, deliverables and service conditions will be those stated in the quotation or booking confirmation issued for your project.

A website enquiry does not create a confirmed booking or require us to accept the project.

​

4. Quotations

​

Unless otherwise stated, quotations are valid for the period shown on the quotation. If no validity period is specified, the quotation will normally remain valid for 14 calendar days.

​

Prices are based on the information supplied by the client at the time the quotation is prepared.

​

We may revise a quotation if:

  • The scope, date, duration or location changes

  • Additional crew or equipment is required

  • The number of people, products, rooms or setups increases

  • The client requests additional deliverables

  • Access, production or permit requirements change

  • The original information supplied was incomplete or inaccurate

  • Travel, accommodation, transport or third-party costs change

  • The project is delayed or extended for reasons outside our control
     

Items not expressly included in the quotation are not included in the price.

5. Booking Confirmation

​

A date is not reserved by an enquiry, verbal discussion, provisional quotation or unpaid invoice.

Unless otherwise confirmed in writing, a booking is only secured when:

​

  1. The client accepts the quotation or scope in writing;

  2. The required deposit or booking fee has been received; and

  3. Any requested booking information or documentation has been supplied.
     

Dates remain available to other clients until these requirements have been completed. We may release a provisionally held date if the deposit is not received within the stated payment period.
 

6. Deposits and Payment
 

Unless otherwise stated in the quotation, a 50% deposit is required to confirm a booking.
 

The remaining balance must be paid in accordance with the invoice or quotation. Unless different terms are agreed in writing, the balance must be settled before the release of final, unwatermarked photographs, videos or other deliverables.

All prices are stated in UAE dirhams and are exclusive of VAT unless expressly stated otherwise. VAT will be charged at the applicable rate.
 

Payments must be made using an approved payment method and without deduction, set-off or unauthorised withholding.

The client is responsible for bank charges, international transfer fees or payment-processing charges imposed by its own bank or payment provider.
 

If a payment becomes overdue, we may:

  • Suspend production or post-production

  • Withhold previews or final deliverables

  • Remove access to online galleries

  • Postpone delivery timelines

  • Decline to begin further work

  • Cancel future bookings

  • Recover reasonable costs incurred in collecting overdue amounts
     

Our right to withhold deliverables does not remove the client’s responsibility to pay amounts properly due under the agreed booking.
 

7. Watermarked Previews
 

Proof galleries, draft edits and preview files may be supplied with watermarks or in reduced resolution for selection and approval purposes.
 

Watermarked previews must not be:

  • Published

  • Downloaded through unauthorised methods

  • Edited

  • Screen-captured for commercial use

  • Shared publicly

  • Used in presentations, advertising or social media

  • Submitted to third parties as final content
     

Final unwatermarked files will be released after the relevant payment and approval requirements have been completed.
 

8. Client Responsibilities
 

The client must provide accurate and complete information about the project, including:

  • Date, timings and location

  • Programme, agenda or production schedule

  • Number of guests, participants or subjects

  • Required images, videos and deliverables

  • Important people, speakers, products or moments

  • Branding, sponsor and shot-list requirements

  • Access restrictions

  • Venue rules

  • Confidentiality requirements

  • Health and safety requirements

  • Delivery deadlines

  • Intended content usage
     

We are not responsible for missed photographs, scenes or deliverables caused by incomplete, inaccurate or late information.
 

The client must appoint an authorised representative who can provide instructions and approvals where needed. Instructions from that representative will be treated as authorised client instructions.
 

9. Shot Lists and Creative Briefs
 

Shot lists, mood boards and reference images are used as guidance and do not guarantee an identical result.

Photography and video production are affected by factors including:

  • Lighting

  • Weather

  • Venue conditions

  • Available time

  • Guest cooperation

  • Subject appearance

  • Access restrictions

  • Programme changes

  • Crowd movement

  • Safety requirements

  • Equipment positioning

  • Location permissions
     

We will use reasonable professional skill to capture the agreed priorities, but we cannot guarantee every requested photograph, angle, person, expression or moment.
 

For live events, weddings and unscripted assignments, certain moments may occur unexpectedly, simultaneously or outside the agreed coverage area.
 

10. Creative Style
 

By booking The Photography Co, the client acknowledges that they have reviewed our portfolio and are familiar with our general photographic, filming and editing style.

Creative decisions may include:

  • Composition

  • Camera angles

  • Lighting

  • Lens choice

  • Posing

  • Background selection

  • Colour treatment

  • Cropping

  • Editing pace

  • Music selection

  • Retouching style

  • Image selection

  • Narrative structure
     

Personal preference alone does not establish that the services were defective where the agreed scope was completed with reasonable professional care.
 

Requests for a substantially different creative direction after the shoot may require additional editing, a reshoot or a revised quotation.
 

11. Shoot Times and Client Delays
 

Coverage time begins and ends at the times stated in the booking confirmation.

The booked time may include:

  • Setup

  • Equipment testing

  • Lighting preparation

  • Safety briefings

  • Access procedures

  • Shooting or filming

  • Equipment breakdown
     

Where the client, venue, subject, guest, product or authorised representative is late or unavailable, the session will normally still end at the originally agreed time.
 

We will make reasonable efforts to accommodate delays, but additional time is:

  • Subject to crew and venue availability; and

  • Chargeable at the applicable overtime rate.
     

If delays make it impossible to complete the planned scope, the client may need to reduce the deliverables, extend the booking or arrange an additional session at extra cost.
 

12. Overtime and Additional Work
 

Work requested beyond the agreed duration or scope will be charged separately.

Additional work may include:

  • Extended shoot time

  • Additional photographers or videographers

  • Extra locations

  • Additional setups or outfit changes

  • Additional products, rooms or people

  • Same-day editing

  • Rush delivery

  • Extra video versions

  • Additional aspect ratios

  • Subtitles or translations

  • Advanced retouching

  • Additional revisions

  • Raw footage preparation

  • Travel or overnight accommodation

  • Permit and venue charges
     

Where possible, additional costs will be approved before the work is performed. Where immediate approval is not practical during a live production, approval given by the client’s authorised on-site representative will be sufficient.
 

13. Locations, Access and Permissions
 

Unless expressly included in our quotation, the client is responsible for obtaining and paying for:

  • Venue approval

  • Location permits

  • Filming permits

  • Drone permissions

  • Security clearance

  • Parking

  • Loading access

  • Power access

  • Property releases

  • Music or performance permissions

  • Event-attendee notices

  • Model or participant consent

  • Any other approval required for the assignment
     

The client must inform us in advance of access procedures, equipment restrictions, dress codes, insurance requirements, safety inductions and identification documents.
 

We are not responsible for delays, reduced coverage or cancellation caused by missing, refused or delayed permissions.

Any permit or third-party charge paid by us on the client’s behalf will be added to the client’s invoice.
 

14. Safety and Professional Conduct
 

We may stop, postpone or refuse work where we reasonably believe that:

  • The location is unsafe

  • Required safety equipment is unavailable

  • Instructions may endanger our crew, the client or the public

  • The activity may be unlawful

  • A subject is being placed at unreasonable risk

  • Our team is subjected to threatening, abusive, discriminatory or inappropriate conduct

  • Equipment may be damaged

  • Venue or authority instructions prohibit the work
     

Stopping work for a genuine safety, legal or conduct concern will not automatically entitle the client to a refund.

The client is responsible for providing a safe working environment and disclosing any known hazards before production.
 

15. Newborn and Child Photography
 

A parent or legal guardian must authorise photography involving a minor. A parent, guardian or authorised adult must remain present or immediately available throughout sessions involving children unless otherwise agreed in writing.
 

Newborn sessions are planned around the baby’s comfort, feeding, settling and sleep. A nurse may be present during designated newborn sessions to help support and comfort the baby.
 

The presence of a nurse does not replace the responsibilities of the parent or guardian, and our services do not constitute medical care or medical advice.
 

We will not perform a pose, setup or activity that we reasonably consider unsafe or unsuitable.
 

16. Cancellation by the Client
 

Cancellation must be communicated in writing by email or another agreed written communication channel.

The booking deposit compensates us for reserving the date, undertaking administration and planning, and potentially declining other work. Deposits are therefore normally non-refundable to the extent permitted by applicable law, unless the quotation states otherwise.
 

Any third-party costs, permits, travel, accommodation, equipment hire, freelancer fees or production expenses already committed on the client’s behalf remain payable.
 

Project-specific cancellation charges may be stated in the quotation or production agreement.

Where no separate cancellation schedule is provided, we may charge a reasonable amount reflecting:

  • Work already performed

  • Non-recoverable expenses

  • Crew and equipment commitments

  • The amount of notice given

  • The likelihood of rebooking the reserved date

  • The total value of the assignment
     

Nothing in this section limits any non-excludable rights available to a consumer under applicable UAE law.
 

17. Rescheduling
 

Studio and Personal Sessions
 

Requests to reschedule a studio or personal photoshoot should be made at least 48 hours before the scheduled start time.

Where sufficient notice is provided, one date change may be permitted without a rescheduling fee, subject to availability and provided that the new session takes place within the period agreed by us.
 

Requests made less than 48 hours before the session may require a new booking deposit.
 

Corporate, Event and Commercial Projects
 

Rescheduling a corporate, event or commercial assignment is subject to:

  • Crew availability

  • Equipment availability

  • Venue availability

  • Third-party commitments

  • Travel arrangements

  • The amount of notice provided
     

Non-recoverable expenses and supplier charges remain payable.
 

If the new date is unavailable, the rescheduling request may be treated as a cancellation.
 

18. Weather and Outdoor Sessions
 

The client accepts that weather, visibility, temperature, wind, rain, humidity, sand, tides and natural lighting cannot be guaranteed.
 

Where weather conditions make an outdoor shoot unsafe or impractical, we may:

  • Delay the start time

  • Move to an alternative location

  • Adjust the creative approach

  • Continue with available conditions

  • Reschedule the outdoor portion

  • Recommend an indoor alternative
     

A cloudy sky, changes in sunlight or personal dissatisfaction with natural weather conditions will not automatically require a free reshoot.
 

Permit, venue, travel, accommodation and third-party costs may remain payable even where the shoot is rescheduled due to weather.
 

19. Cancellation by The Photography Co
 

We may cancel or reschedule a booking where performance becomes impossible or unreasonable due to:

  • Serious illness or emergency

  • Unsafe working conditions

  • Government restrictions

  • Venue closure

  • Permit refusal

  • Equipment failure that cannot reasonably be replaced

  • Force majeure

  • Non-payment

  • Material client breach

  • Abusive or unlawful conduct
     

Where we cancel for reasons within our reasonable control and cannot provide a suitable replacement or alternative date, our liability will normally be limited to refunding amounts paid for the affected and unperformed services.

We may, with the client’s agreement, provide a suitably experienced replacement photographer, videographer or crew member.
 

20. Force Majeure
 

Neither party will be liable for delay or failure caused by circumstances reasonably beyond its control, including:

  • Natural disasters

  • Severe weather

  • Fire or flooding

  • Epidemics or public-health restrictions

  • War, civil unrest or terrorism

  • Government action

  • Venue closure

  • Transport disruption

  • Power or telecommunications failure

  • Labour disputes

  • Permit or authority restrictions

  • Serious illness or emergency

  • Any comparable event beyond reasonable control
     

The affected party should notify the other party as soon as reasonably practical.
 

The parties will attempt to reschedule or agree a reasonable alternative. Non-recoverable third-party costs and work already completed may remain payable.
 

21. Image Selection
 

Where the package includes a specific number of edited images, the client will select those images from a proof gallery unless otherwise agreed.
 

The client should complete selections within the timeframe stated in the gallery or booking confirmation.

Delivery timelines begin after the client has:

  • Completed the image selection

  • Supplied required information

  • Approved the relevant draft

  • Paid any amount due
     

If the client does not provide selections within a reasonable period, we may archive the project and charge a reactivation or administration fee before work resumes.
 

Unselected images are not automatically included.
 

22. Editing and Retouching
 

Standard editing may include:

  • Exposure and colour correction

  • White-balance adjustment

  • Cropping and alignment

  • Contrast adjustment

  • Basic skin retouching

  • Minor distraction removal

  • Overall image consistency
     

Unless expressly included, standard editing does not include:

  • Major body or facial reshaping

  • Complex object removal

  • Clothing replacement

  • Background reconstruction

  • Compositing

  • Extensive skin alteration

  • Product reconstruction

  • Architectural modification

  • Advanced beauty retouching

  • Creation of missing details

  • Changes requiring generative artificial intelligence

  • Unlimited revisions
     

Additional or advanced retouching will be quoted separately.
 

We aim to maintain natural appearances and are not obliged to make edits that are misleading, unsafe, unlawful, discriminatory or inconsistent with our professional standards.
 

23. Video Revisions
 

The number of included video revision rounds will be stated in the quotation.
 

A revision round means one consolidated set of feedback submitted by the client’s authorised representative.

Feedback should be:

  • Clear

  • Time-stamped where applicable

  • Consolidated into one document or message

  • Submitted within the agreed review period
     

Conflicting or fragmented feedback from multiple people may delay delivery and may be treated as additional revisions.

Changes to the original brief, script, music direction, structure or creative concept may be charged separately even when requested during an included revision round.
 

Once a video has been approved, further changes may incur an additional fee.
 

24. Delivery Timelines
 

Delivery times are estimates unless a specific deadline is expressly guaranteed in writing.

Typical timelines may vary by service, project size, selection process, revision requirements and production schedule.

Unless otherwise stated:

  • Event photographs are normally delivered within approximately three business days.

  • Standard proofing galleries may take up to one week.

  • Final retouched images are normally delivered after the client completes selections.

  • Video delivery depends on duration, complexity and revision requirements.
     

Rush delivery, same-day edits and priority processing must be agreed in advance and may involve an additional charge.

We are not responsible for delays caused by late feedback, incomplete selections, unpaid invoices, missing assets, changing instructions or third-party approvals.
 

25. Delivery Method and File Storage

Final files may be delivered through:

  • A private online gallery

  • A cloud-storage link

  • A digital transfer service

  • Client-supplied storage

  • Another agreed delivery system
     

The client is responsible for downloading and safely backing up the delivered files before the link or gallery expires.

We do not guarantee permanent storage of project files.
 

Although we may retain project files for a limited period, the client should maintain independent backups of all downloaded deliverables.
 

Restoring archived files, where available, may incur an administration or retrieval fee.

26. Raw Files and Unedited Material
 

RAW photographs, unedited images, project files, timelines, working files, colour-grading files, source graphics and unused footage are not included unless expressly stated in the quotation.

RAW and unedited materials are unfinished production assets and may not represent the quality or style of the final commissioned work.
 

Where the supply of raw footage or other source material is agreed:

  • An additional fee may apply

  • Full payment must be received before release

  • Preparation and transfer time may be charged

  • The files may be supplied without editing, colour correction or organisation

  • Specialist software may be required to open them

  • We are not responsible for changes made by the client or third parties after delivery
     

Providing raw files does not automatically transfer copyright or ownership of intellectual property.
 

27. Copyright
 

Unless copyright is expressly transferred through a signed written agreement, The Photography Co and/or the relevant creator retains copyright in the photographs, videos and other original works we create.

Payment for services does not by itself transfer copyright ownership.
 

The client receives the usage rights described in the quotation, licence or written agreement once all applicable invoices have been paid.
 

The client must not claim authorship of the work or remove copyright information where such information has been included, except where otherwise agreed.
 

28. Client Usage Rights
 

Personal Clients
 

Unless otherwise stated, personal-session clients receive a non-exclusive licence to use final delivered images and videos for private, personal and non-commercial purposes.
 

This generally includes:

  • Personal social-media accounts

  • Personal prints

  • Sharing with family and friends

  • Personal announcements
     

Commercial advertising, resale, publication by a business or licensing to a third party requires written permission.
 

Business and Corporate Clients
 

Where the quotation does not contain a separate usage licence, a business client receives a perpetual, non-exclusive licence to use the final paid deliverables for its own:

  • Website

  • Social-media accounts

  • Public relations

  • Editorial communications

  • Internal communications

  • Presentations

  • Recruitment

  • Reports

  • Organic and paid marketing

  • Corporate promotional materials
     

This licence does not include:

  • Reselling the content as a standalone product

  • Licensing it to unrelated third parties

  • Claiming copyright ownership

  • Registering the content as a trademark

  • Using it to train artificial-intelligence systems

  • Creating misleading or unlawful material

  • Transferring ownership without written approval
     

Usage by the client’s appointed agency, publisher, venue or media partner is permitted where it is directly connected to the client’s own project and purpose.
 

Broader usage, exclusivity, copyright assignment, product resale, merchandising, syndicated licensing or third-party campaigns may require a separate written licence and fee.
 

29. Client-Supplied Materials
 

The client confirms that it has the necessary rights and permissions to provide and authorise the use of any:

  • Logos

  • Music

  • Photographs

  • Videos

  • Scripts

  • Fonts

  • Graphics

  • Designs

  • Brand assets

  • Voice recordings

  • Data

  • Third-party content
     

The client is responsible for claims arising from materials supplied or specifically instructed by the client, except to the extent caused by our unauthorised use.
 

30. Music and Licensed Assets
 

Where music, stock footage, templates, fonts or other licensed assets are included, their use may remain subject to the licence terms of the relevant provider.
 

A licence obtained for a specific video or platform may not cover:

  • Television broadcasting

  • Cinema

  • Paid media

  • Worldwide campaigns

  • Resale

  • Re-editing

  • Use by unrelated third parties
     

The client must notify us before production where extended or unusual licensing is required.

Additional licensing fees will be charged to the client.
 

31. Portfolio and Promotional Use
 

Commercial Projects and Public Events
 

Unless confidentiality or usage restrictions are agreed in writing before the assignment, we may display selected non-confidential final work for:

  • Our website and portfolio

  • Social media

  • Showreels

  • Awards

  • Proposals

  • Presentations

  • Marketing and promotional materials
     

We will not knowingly publish confidential information or unreleased material where written confidentiality restrictions have been agreed.
 

Private, Family and Newborn Sessions
 

Images from private family, maternity, newborn, baby or personal sessions will not be used publicly for our portfolio or marketing without the client’s consent.
 

Where consent is provided, it may be recorded in the booking form, model release, email or another clear written communication.
 

A client may contact us to withdraw future promotional use. Withdrawal will not necessarily affect materials already printed, published, distributed or lawfully used before the request was received.
 

32. Event Guests and Participant Consent
 

For corporate events, conferences, private functions and organised productions, the client or organiser is responsible for determining and obtaining any notices, releases or permissions required from guests, speakers, performers, employees, models and participants.
 

The client should inform us before the assignment of anyone who must not be photographed or filmed.

We will make reasonable efforts to follow such restrictions when they are clearly communicated and operationally practical.
 

33. Confidentiality
 

Where a project involves confidential information, the client must notify us before the booking and identify the specific confidentiality requirements.
 

We can enter into a separate non-disclosure agreement where appropriate.
 

Unless otherwise agreed, confidentiality does not prevent us from:

  • Retaining records required for legal, accounting or operational purposes

  • Sharing information with crew members and suppliers who need it to perform the project

  • Disclosing information where required by law, regulation or court order

  • Using anonymised operational information that does not identify the client
     

34. Artificial Intelligence
 

We will not knowingly use identifiable client photographs, videos or confidential materials to train public artificial-intelligence models without appropriate authority.
 

Where generative AI or AI-assisted editing is requested or used as part of a project, we may use it for purposes such as:

  • Background extension

  • Object removal

  • Concept visualisation

  • Image enhancement

  • Transcription

  • Captioning

  • Workflow assistance
     

AI-generated or AI-assisted outputs may contain inaccuracies or inconsistencies. Where AI use is a material part of the final deliverable, the scope and approval process should be agreed in writing.
 

35. Equipment Failure and Data Loss
 

We use professional equipment, backup systems and reasonable file-management procedures. However, no camera, memory card, hard drive, network or digital-storage system is entirely free from risk.
 

If deliverables are lost, damaged or materially incomplete due to equipment failure, corruption or circumstances within our reasonable control, we will assess the available remedies, which may include:

  • Recovery attempts

  • Re-editing

  • A reshoot where reasonably possible

  • Partial refund

  • Refund of the affected service fee
     

Any remedy will depend on the nature of the project, available files and whether the assignment can reasonably be repeated.
 

Nothing in these Terms excludes liability that cannot lawfully be excluded.
 

36. Limitation of Liability
 

To the fullest extent permitted by applicable law:

  • We are not liable for indirect, incidental or consequential loss.

  • We are not liable for loss of profit, revenue, opportunity, reputation, contracts or anticipated savings.

  • We are not liable for delay or failure caused by the client, venue, guests, suppliers, authorities or circumstances outside our reasonable control.

  • Our total liability connected with a particular booking will not exceed the amount paid to us for the affected services.
     

These limitations do not apply where liability cannot legally be limited or excluded, including applicable rights relating to personal injury, fraud, wilful misconduct or statutory consumer protection.
 

The client is responsible for maintaining appropriate insurance for high-value events, productions, products, property and business interruption.
 

37. Complaints
 

Any concern should be reported as soon as reasonably possible so that we have an opportunity to investigate and respond.

Complaints about delivered content should normally be submitted within seven calendar days of delivery and should clearly identify:

  • The affected image, video or service

  • The nature of the concern

  • The relevant agreed requirement

  • The requested resolution
     

We will review complaints fairly and may request supporting information.

Submitting a complaint does not suspend properly due payment obligations unless agreed in writing.
 

38. Refunds
 

Refunds are assessed according to:

  • The agreed scope

  • Work already completed

  • Reserved crew and production time

  • Non-recoverable expenses

  • The reason for cancellation or complaint

  • Any project-specific agreement

  • Applicable UAE law
     

No refund is due merely because:

  • A client changes their mind

  • A participant dislikes their appearance

  • Weather or venue conditions were beyond our control

  • A requested moment did not occur

  • The work reflects the agreed creative style

  • The client did not use the delivered content

  • The client failed to provide required access, information or cooperation
     

This section does not limit any refund or remedy required under applicable law.
 

39. Privacy and Personal Information
 

Personal information submitted through our website, booking forms, emails, payment systems and project communications will be handled in accordance with our Privacy Policy and applicable data-protection requirements.

The client should review our separate Privacy Policy for information about:
 

  • Data collection

  • Processing purposes

  • Service providers

  • Storage

  • Marketing communications

  • International transfers

  • Data-subject rights

  • Contact procedures
     

The client must not provide sensitive or confidential personal information unless it is necessary for the project and appropriate security arrangements have been agreed.
 

40. Website Intellectual Property

43. Electronic Communications and Acceptance
 

The parties agree that quotations, approvals, booking confirmations, invoices, notices and other communications may be provided electronically.
 

Acceptance may be demonstrated through actions including:

  • Signing electronically

  • Clicking an acceptance box

  • Confirming by email or WhatsApp

  • Paying a deposit

  • Paying an invoice

  • Instructing us to begin work

  • Proceeding with the booked service after receiving these Terms
     

The client should retain copies of the quotation, invoice and applicable Terms for its records.
 

44. Changes to These Terms
 

We may update these Terms to reflect changes in our services, processes, technology or legal obligations.

The updated version will be published with a revised “Last updated” date.
 

The version applying to a confirmed booking will normally be the version accepted at the time of booking, unless:

  • The parties agree otherwise;

  • The update is required by law; or

  • A project-specific agreement replaces it.
     

45. Severability
 

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
 

The affected provision will be interpreted or adjusted only to the minimum extent necessary to make it valid and enforceable.
 

46. No Waiver
 

If either party delays or does not enforce a right under these Terms, that does not permanently waive the right.

A waiver is only effective where clearly confirmed in writing.
 

47. Governing Law and Jurisdiction
 

These Terms and any dispute or claim connected with them are governed by the applicable laws of the United Arab Emirates and the Emirate of Dubai.
 

Before beginning formal proceedings, the parties should attempt in good faith to resolve the dispute through written discussion.
 

Subject to any mandatory consumer-protection process or jurisdiction, the courts of Dubai will have jurisdiction over unresolved disputes.
 

48. Statutory Rights
 

Nothing in these Terms is intended to exclude, restrict or override any right or remedy that cannot lawfully be excluded under applicable UAE law.
 

Where the client is legally considered a consumer, mandatory consumer-protection rights will continue to apply.
